These Terms and Conditions (the “Terms”) set out the rules for using the Store, placing orders, concluding distance sales contracts, payment, delivery, complaints, and the Consumer’s right of withdrawal. They apply to sales of upholstered furniture via the Store.
§1. General Information
• The Store sells upholstered furniture via distance selling (online).
• The Seller provides product information, pricing, delivery options, and available payment methods in the Store interface.
• The Customer is required to provide accurate and complete data necessary for order processing and delivery.
• The Seller may contact the Customer to clarify an order if required to fulfil the contract.
§2. Definitions
• Customer – any natural or legal person placing an order in the Store.
• Consumer – a natural person acting for purposes outside their trade, business or profession.
• Goods – upholstered furniture offered in the Store.
• Sales Contract – a distance contract concluded between the Seller and the Customer.
• Working Day – Monday to Friday, excluding public holidays in the Netherlands.
§3. Placing Orders and Contract Conclusion
Orders can be placed 24/7 via the Store’s website. To place an order, the Customer must select the Goods, add them to the cart, complete the order form, accept these Terms, and proceed to payment (if required by the chosen method).
The Sales Contract is concluded when the Seller confirms acceptance of the order by email. The Seller may refuse an order in justified cases (e.g., obvious errors in pricing or unavailability).
§4. Prices and Payments
All prices are stated in euros (EUR) and include VAT, unless explicitly stated otherwise. Delivery costs and any additional fees are displayed before the Customer places the order.
• Available payment methods include bank transfer, electronic payment methods, and other methods indicated in the Store.
• If payment is required in advance, the Seller will start processing the order after receiving the payment, unless stated otherwise.
• The Seller reserves the right to change prices, but changes do not affect orders already placed and confirmed.
§5. Delivery
Delivery is available within the European Union. The estimated production and/or delivery time is stated in the product description or in the order confirmation. Delivery times may vary depending on product availability, made-to-order production, and carrier constraints.
• Delivery costs are shown before the order is placed.
• The Customer should inspect the packaging upon delivery and report visible damage to the carrier and to the Seller as soon as possible.
• Risk of loss passes to the Consumer upon delivery to the Consumer or a person indicated by the Consumer, unless mandatory law provides otherwise.
§6. Right of Withdrawal (Consumers)
A Consumer has the right to withdraw from the Sales Contract within 14 days from the day the Consumer (or a third party indicated by the Consumer, other than the carrier) receives the Goods, without giving any reason.
Exclusion: The right of withdrawal does not apply to contracts for Goods made to the Consumer’s specifications or clearly personalized (for example: choice of fabric, colour, dimensions, configuration). This exclusion follows Article 6:230p of the Dutch Civil Code (Burgerlijk Wetboek).
• To exercise the right of withdrawal, the Consumer must inform the Seller of their decision by an unequivocal statement (e.g., email). The model withdrawal form in the Annex may be used but is not mandatory.
• The Consumer must return the Goods without undue delay and no later than 14 days after notifying the Seller.
• The Consumer is responsible for any diminished value of the Goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
• The Seller shall refund all payments received from the Consumer, including standard delivery costs (if applicable), within 14 days after receiving the returned Goods or evidence of return, whichever is earlier.
The Seller may withhold the refund until the Goods are received or evidence of return is provided.
§7. Complaints, Non-conformity and Legal Warranty
The Seller is liable for the conformity of the Goods in accordance with Dutch law (Burgerlijk Wetboek) and applicable EU consumer rules. If the Goods are not in conformity with the contract, the Consumer may be entitled to remedies such as repair, replacement, price reduction, or termination, depending on the circumstances and mandatory law.
• Complaints should be submitted by email to contact@flowcraft.nl, with a description of the issue and photo documentation.
• The Seller will respond to a complaint within 14 days of receipt. If more time is needed, the Seller will inform the Customer.
• Where appropriate, the Seller may request additional information needed to assess the complaint (e.g., serial/production label, additional photos).
§8. Personal Data (GDPR)
The controller of personal data is FlowCraft. Personal data is processed for the purpose of order placement, contract performance, payments, delivery, complaint handling and (where applicable) compliance with legal obligations, in accordance with the General Data Protection Regulation (GDPR).
Customers have the right to access, rectify, erase, restrict processing, object to processing (where applicable), and data portability. Customers may lodge a complaint with a supervisory authority.
§9. Final Provisions
• These Terms are governed by Dutch law, without prejudice to mandatory consumer protection rights under EU law.
• The Seller reserves the right to amend these Terms for important reasons (e.g., changes in law, changes in payment or delivery methods). Changes do not affect contracts already concluded.
• The current version of the Terms is available on the Store’s website.
